General Terms of Sale | Hello Chantier

1. Purpose and scope

These General Terms of Sale (GTS) govern the contractual relationship between Fourmi Un SAS, publisher of the Hello Chantier platform, and the building Professionals who subscribe to a paid plan. They cover the supply of the platform's paid services and supplement the Terms of Service (ToS), which govern general use of the platform. By subscribing to a plan, the Professional acknowledges having read and unreservedly accepted these GTS. Access to the platform remains entirely free for Project Owners, who are not concerned by these GTS.

2. Operator identity

The Hello Chantier platform is published and operated by Fourmi Un SAS, a simplified joint-stock company with share capital of €100.00, registered with the Cannes Trade and Companies Register under number 943 141 085, with its registered office at 10 Avenue Saint-Jean, 06400 Cannes (France). 3. Plans offered

Hello Chantier offers Professionals two access plans: a FREE plan, which gives access to the platform's basic features (profile creation, directory listing, receiving opportunities) at no cost; and a PRO plan, at approximately €29 per month, which unlocks all advanced features (unlimited quote and invoice management, project tracking tools, enhanced directory visibility, priority support and artificial-intelligence features). The detail of the features included in each plan and the current prices are presented on the platform's pricing page, which prevails. Hello Chantier reserves the right to change the content of its plans.

4. Prices, billing and payment

Subscription prices are stated in euros, inclusive of all taxes, on the pricing page. The PRO plan is billed according to the billing cycle chosen at subscription, monthly or annually, and renews automatically by tacit renewal at each due date. Payments are processed securely by our provider Stripe; Fourmi Un SAS never has access to your full bank details. In the event of a failed payment, access to paid features may be suspended until the situation is resolved. Fourmi Un SAS reserves the right to change its prices, informing the Professional at least 30 days before the new prices take effect; failing termination before that date, the new prices are deemed accepted.

5. Term and renewal

The subscription is taken out for the period corresponding to the chosen billing cycle (month or year) and renews tacitly for successive periods of the same duration, unless terminated under the conditions set out in article 7. In accordance with article L. 215-1 of the French Consumer Code, where the Professional qualifies as a non-professional or a consumer, Fourmi Un SAS informs them in writing of the option not to renew the subscription before each due date.

6. Right of withdrawal

In accordance with articles L. 221-18 et seq. of the French Consumer Code, consumers have a period of fourteen (14) days from subscription to exercise their right of withdrawal, without having to give a reason. However, as Hello Chantier subscriptions are taken out by Professionals in the course of their business, the right of withdrawal does not apply where the contract is concluded for purposes falling within the scope of the subscriber's professional activity. Where the right of withdrawal applies, a Professional who requests immediate performance of the service before the end of the withdrawal period acknowledges that this right is extinguished once the service has been fully performed. 7. Termination

The Professional may terminate their subscription at any time from their account management area or by contacting communication@hellochantier.com. Termination takes effect at the end of the current subscription period; amounts already paid for the current period are not refunded, save for any mandatory legal provision to the contrary. After termination, the Professional retains access to the FREE plan. Fourmi Un SAS reserves the right to suspend or terminate a Professional's subscription as of right in the event of a serious breach of these GTS or the ToS, in particular in the event of fraud or non-payment.

8. Role of the platform

Hello Chantier acts solely as a technical intermediary connecting Project Owners and Professionals. As such, Fourmi Un SAS is not a party to any works contract concluded between a Project Owner and a Professional and does not take part in the negotiation, conclusion or performance of such contracts. The paid subscription taken out by the Professional relates solely to access to the platform's features and in no way constitutes a guarantee of obtaining projects or income. Fourmi Un SAS receives no commission on the works carried out between users.

9. Quotes and contracts between users

The works quotes, contracts and invoices exchanged between Project Owners and Professionals fall solely within their own contractual relationship and are concluded outside the scope of these GTS. The tools made available by Hello Chantier (quote and invoice generation, project tracking) are provided as assistance and do not confer on Fourmi Un SAS any status as a party to the works contracts. It is the responsibility of each user to ensure that the documents exchanged comply with the regulations applicable to their activity. Fourmi Un SAS cannot be held liable for the content, performance or any disputes relating to these contracts.

10. Liability

Fourmi Un SAS undertakes to provide the paid services with due care, without however guaranteeing uninterrupted availability of the platform. Fourmi Un SAS cannot be held liable in the event of force majeure, the act of a third party or misuse of the service by the Professional. In any event, Fourmi Un SAS's liability under these GTS is limited to proven direct damages and cannot exceed the amount of the sums paid by the Professional during the twelve (12) months preceding the event giving rise to the damage.

11. Amendment of the GTS

Fourmi Un SAS reserves the right to amend these GTS at any time, in particular to comply with changes in applicable regulations or to the platform. In the event of a substantial change, the Professional will be informed by email or by in-app notification at least 30 days before the new terms take effect. Continuing the subscription after that date constitutes acceptance of the new GTS; failing this, the Professional may terminate their subscription under the conditions of article 7.

12. Governing law and dispute resolution

These GTS are governed by French law. In the event of a dispute, the parties will endeavour to seek an amicable solution before any legal action. In accordance with articles L. 612-1 et seq. of the French Consumer Code, consumers may use a consumer mediator free of charge to resolve the dispute amicably. Failing an amicable resolution, the French courts shall have sole jurisdiction.
