1. Acceptance of Terms
By accessing and using the Hello Chantier platform, available at hellochantier.com, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use without reservation. If you do not accept these terms, you must immediately cease using the platform. Access to Hello Chantier is reserved for individuals who are at least 18 years of age and have full legal capacity. Hello Chantier is operated by Fourmi Un SAS, a French simplified joint-stock company.
2. Description of Services
Hello Chantier is a digital platform connecting homeowners with construction and renovation projects ("Project Owners") with building professionals ("Professionals"). The platform offers a verified professional directory, a quote and invoice management system, construction project tracking tools, integrated messaging, and project management features. Access to the platform is free for Project Owners. Professionals access the platform through a paid subscription, the terms of which are detailed in Article 8 of these Terms. Hello Chantier reserves the right to evolve the features offered without prior notice.
3. User Accounts
Creating an account is required to access the platform's features. When registering, you agree to provide accurate, complete, and up-to-date information. You are solely responsible for the confidentiality of your login credentials and all actions performed from your account. In the event of loss, theft, or unauthorized use of your credentials, you must immediately notify Hello Chantier at communication@hellochantier.com. Fourmi Un SAS reserves the right to suspend or delete any account that does not comply with these Terms, without prior notice or compensation.
4. User Obligations
By using Hello Chantier, you agree to comply with applicable French law and not to infringe the rights of third parties. You are specifically prohibited from posting false, misleading, or defamatory information, impersonating a third party, sending unsolicited communications (spam), using bots or automated tools to scrape data from the platform, and disrupting the technical operation of the service. Any fraudulent, abusive, or non-compliant behavior may result in the immediate suspension of your account and, where applicable, legal proceedings.
5. Intellectual Property
All elements constituting the Hello Chantier platform — including source code, graphics, logos, texts, icons, and databases — are the exclusive property of Fourmi Un SAS and are protected by French and international intellectual property law. By posting content on the platform (reviews, photos, project descriptions, etc.), you grant Fourmi Un SAS a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content in connection with the operation of the service. Any unauthorized reproduction, representation, modification, or exploitation of any element of the platform is strictly prohibited and constitutes an infringement punishable under the Intellectual Property Code.
6. Limitation of Liability
Hello Chantier acts as a technical intermediary and is not a party to any contract concluded between Project Owners and Professionals. Fourmi Un SAS does not guarantee the quality of services rendered by Professionals listed on the platform and shall not be held liable for disputes arising between users in the context of their contractual relationships. The platform is provided "as is" and Fourmi Un SAS does not guarantee uninterrupted availability of the service. In any event, the liability of Fourmi Un SAS is limited to direct proven damages and shall not exceed the amounts paid by the user over the preceding twelve months.
7. Personal Data
The collection and processing of your personal data are governed by our Privacy Policy, accessible on the platform. Fourmi Un SAS processes your data in compliance with the General Data Protection Regulation (GDPR). You have the right to access, rectify, erase, port, and object to the processing of your personal data, which you may exercise by sending your request to communication@hellochantier.com. In the event of a dispute regarding the processing of your data, you have the right to lodge a complaint with the relevant data protection authority.
8. Pricing and Payment
Access to the platform is free for Project Owners. Professionals subscribe to a plan whose price varies according to the chosen tier, as indicated on the platform's pricing page. Payments are processed securely by our payment provider, Stripe. Subscriptions are billed at regular intervals (monthly or annually) and renew automatically. Fourmi Un SAS reserves the right to modify its pricing by notifying you of the change with a minimum of 30 days' notice; failure to cancel before the effective date of the new pricing constitutes acceptance thereof.
9. Modifications to These Terms
Fourmi Un SAS reserves the right to modify these Terms at any time, in particular to comply with evolving applicable regulations or to reflect changes to the platform. In the event of a substantial modification, you will be notified by email or in-app notification at least 15 days before the new terms take effect. Continued use of the platform after the effective date of the updated Terms constitutes unconditional acceptance of those terms. If you do not accept the modifications, you must cease using the platform and delete your account.
10. Governing Law and Dispute Resolution
These Terms are governed by French law. In the event of a dispute relating to the interpretation or performance of these Terms, you agree to first seek an amicable resolution by contacting our customer service at communication@hellochantier.com. Failing an amicable agreement, the competent French courts shall have exclusive jurisdiction over the dispute. In accordance with applicable consumer protection regulations, consumers may have the right to access a free consumer mediation service for the amicable resolution of any dispute with a professional.
